1. Acceptance of Terms

By signing a membership agreement, waiver, class registration, or by using our services in any way, you agree to these Terms of Service (these “Terms”) and related policies (e.g., Waiver & Release, Privacy Policy). If you do not agree, do not sign or use our services.

2. Services

REform Pilates Studio provides Pilates instruction (including Reformer classes), private sessions, workshops, retail sales, and related services (collectively, “Services”).

3. Registration, Medical Disclosure & Assumption of Risk

3.1 You must complete our intake form and disclose any medical conditions, injuries, pregnancies, or limitations before participating. You affirm that you are physically able and medically cleared to participate.

3.2 Participation in Pilates and use of reformer equipment carry inherent risks (including but not limited to sprains, strains, falls, aggravated medical conditions, or death). You voluntarily assume all such risks associated with participation. See the Waiver & Release.

4. Waiver, Release & Liability Limitation

4.1 As a condition of participation, you will be required to sign a Waiver & Release that releases REform Pilates Studio, its owners, officers, employees, contractors, and agents from liability for injury, death, or damage arising out of your participation to the fullest extent permitted by Missouri law. The waiver will include assumption of risk, express release of claims for ordinary negligence (where permitted), agreement to follow studio rules and instructor directions, and indemnification for claims you cause. It cannot waive liability for gross negligence, intentional acts, or other liabilities prohibited by law.

4.2 Minors (persons under 18) require a parent or legal guardian signature; certain releases may be limited in enforceability for minors.

5. Membership & Contract Terms

5.1 THREE (3) BUSINESS DAY CANCELLATION RIGHT: Under Missouri law, if you sign a health/fitness membership contract, you have the right to cancel the contract within three (3) business days of signing and receive a full refund of amounts paid. To cancel, provide written notice as described in the Notices section below. Refunds will be provided within 30 days of timely cancellation.

5.2 Contract duration and renewals: Contract duration will be clearly disclosed in your membership agreement. Contracts should not exceed twenty-four (24) months unless an exception applies. Automatic-renewal clauses are disfavored and should not be relied upon without clear, conspicuous consent.

5.3 Payment authorizations, late fees, returned-payment fees, and direct-debit policies will be clearly disclosed in the membership agreement. Members must provide up-to-date payment information and authorize recurring billing where applicable.

6. Cancellations, Freezes & Refunds

6.1 Three-Day Cancellation: You have three (3) business days after signing to cancel a health/fitness contract and receive a full refund of amounts paid, as described above.

6.2 Contract Cancellation / Termination by Member: After the three-day period, cancellation rights, notice periods, and any pro-rata refunds will be governed by the specific membership agreement you sign with REform Pilates Studio.

6.3 Freezing Memberships: Temporary freezes may be allowed for medical reasons or other legitimate causes; terms and fees (if any) will be set forth in the membership agreement.

6.4 Refunds for Classes/Workshops: Class and workshop refund policies are described at booking; refunds are provided at studio discretion except where statute requires otherwise.

7. Studio Rules & Code of Conduct

Participants must follow instructor directions and studio policies (safety rules, equipment use, hygiene, scheduling). Failure to follow rules may result in removal from class without refund. No photography/video recording of other clients or instructors without permission.

8. Privacy & Personal Data

We collect contact, medical, and payment information to provide Services. Our Privacy Policy explains how we collect, use, retain, and secure personal data. By accepting these Terms you also accept the Privacy Policy. We will comply with applicable Missouri and federal privacy laws.

9. Health & Safety Policies

We may establish health and safety protocols (screening, sanitation, masking) as required by public health guidance. Failure to follow required protocols may result in refusal of participation.

10. Insurance

Participants are encouraged to maintain personal health/accident insurance. REform Pilates Studio carries general liability insurance; insurance does not replace individual responsibility for safety.

11. Dispute Resolution, Governing Law, and Venue

11.1 Governing Law: These Terms are governed by the laws of the State of Missouri.

11.2 Venue: Unless otherwise agreed, any legal action relating to these Terms must be brought in the state or federal courts located in Boone County, Missouri.

11.3 Alternative Dispute Resolution: Where permitted by law, disputes may be resolved by arbitration if clearly and voluntarily agreed to by the parties. Arbitration provisions must be conspicuous and optional language should be provided where appropriate.

12. Intellectual Property

All content, logos, images, and materials on our website and in studio materials are the property of REform Pilates Studio LLC unless otherwise stated. You may not reproduce our trademarks or copyrighted materials without written consent.

13. Amendments to Terms

We may update these Terms from time to time. For existing members, material changes to membership contract terms will be made in accordance with contract provisions and applicable law. Updated Terms will be posted at the studio and on our website.

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remainder of the Terms will remain in effect.

Statutory & Practical Notes (for studio owner / legal counsel):

  • Missouri law requires that health club contracts provide a penalty-free cancellation within three business days and a refund within 30 days of a timely cancellation. Consult Missouri statutes and Attorney General guidance.

  • Waivers/exculpatory language may be enforceable in Missouri but courts consider specificity, public policy, and the presence of gross negligence or intentional misconduct.

  • Have a Missouri-licensed attorney review and finalize this Terms of Service and any Waiver & Release before using them with clients.
